Unauthorized Persons

In accordance with Education Code §37.105, a school administrator, school resource officer (SRO), or district police officer shall have the authority to refuse entry or eject a person from district property if the person refuses to leave peaceably on request and;

  1. The person poses a substantial risk of harm to any person; or
     

  2. The person behaves in a manner that is inappropriate for a school setting, and the person persists in the behavior after being given a verbal warning that the behavior is inappropriate and may result in refusal of entry or ejection.

Appeals regarding refusal of entry or ejection from a district property may be filed in accordance with FNG(LOCAL) or GF(LOCAL), as appropriate.  Texas Administrative Code §103.1207 requires individuals appealing under this section be allowed to address the Board of Trustees in person within 90 days of the appeal first being filed unless the appeal is earlier granted by District administration.  Board policy GKA will be revised in accordance with Board procedures to effectuate compliance with this provision.
